Revisited: Eagle Creek Marathon

Last year, we took a look at the public information available on Mr. Gurpreet Singh and Six Mile Investments’s other nearby gas station in an an article titled “A Sister Station: Eagle Creek Marathon“. It’s worth noting, that article has become one of the most popular on the site – including a lot of traffic from search engines. In this post, we hope to revisit and see how things have changed over the past year at the Eagle Creek Marathon Gas Station located at (5820 West 56th St, Indianapolis, IN 46254). This may help us understand the potential type and quality of a gas station, convenience store and retail shops we could expect at 86th & Lafayette Road.

Health Department Violations:

During the last update, numerous health department violations were found. (Source) Including:

  • Propane tanks located inside of the establishment
  • Food not held at the proper temperature.
  • Toxic materials stored next to food products and service items
  • Food preparation equipment soiled.
  • Food handler not wearing hair restraints
  • Trash cans heavily soiled
  • Ceiling tiles stained
  • Floor soiled
  • Improper installation of fixed equipment and sealing
  • Shelves and drain lines in cooler soiled
  • Flour bin soiled
  • No test kit to check sanitizer levels
  • Hand sink faucet leaks
  • Cardboard lining shelves on sales floor
  • Plastic cup used for scoop in sugar container
  • Ice dispensing platform soiled
  • Food stored in unprotected manner
  • No thermometer in cooler
  • Vent hood soiled
  • Previously cooked fried chicken stored in used plastic grocery bags in cooler
  • Pizza lamp not holding pizza at proper temperatures
  • Establishment missing “No Smoking” Sign.

On May 4, 2016 the Health Department conducted a routine inspection of their convenience store. They had the following health department violations:

  • Toxic material(s) improperly stored in the Kitchen. (CRITICAL)
    • Motor oil stored next to soft drinks. Separate toxins away from food and beverages.
  • Raw animal foods stored incorrectly over ready to eat foods and/or other raw foods. (CRITICAL)
    • Cooked and wrapped BBQ sandwiches stored in a used cardboard box that was originally used to store raw chicken. Do not store foods in box that was used to store raw chicken. Use a clean and sanitary container only.

    Kitchen: Potentially hazardous food(s) not held at proper temperatures. (CRITICAL)

    • 1. Fried chicken, potato wedges and chicken gizzards holding at 117 degrees F in hot case. Maintain hot foods at 135 degrees F or higher. 2. Cooked noodles and marinara sauce out on counter at 68 degrees F. Maintain hot foods at 135 degrees F or higher. Cool cooked foods in an ice bath and retun to refrigeration if you plan to re-heat food for later service.
  • Service Counter: Potentially hazardous food(s) not held at proper temperatures. (CRITICAL)

  • Smoking signs not posted conspicuously at each public entrance.
    • Establishment missing no smoking sign from main entrance. Sign given to owner, corrected on site.
  • Service Counter: Potentially hazardous cold foods shall be held at 41 degrees F or lower. (CRITICAL)
    • 1. Opened Buttermilk ranch dressing in souffle cups out for service at 74 degrees F. Ranch dressing container is marked to keep refrigerated after opening. Maintain opened ranch dressing at 41 degrees F or below. 2 souffle cups were discarded.
  • Improper drying of wet mop(s).
    • Mop lying inside a wet and dirty mop bucket. Empty mop bucket and allow mops to air dry when not in use.
  • Potentially hazardous food(s) thawing improperly
    • Raw fish and raw chicken livers thawing at room temperature at 60 degrees F. Thaw using one of the following methods: under refrigeration or completely submerged under running water at a temperature of 70 degrees F or below.
  • Cold and hot holding equipment used to store potentially hazardous food is not equipped with at least one thermometer that is located to allow easy viewing of the temperature display.
    • No visible thermometer in ice cream freezer. Provide a thermometer.
  • Equipment in need of repair.
    • 1. Soda syrup is leaking onto floor at soda racks. Repair leak and clean floor.
    • 2. Large amount of ice build up on floor of walk in freezer. Defrost unit/remove ice build up.
  • Plumbing system(s) not maintained in good repair.
    • Toilet tank loose. Secure toilet tank to the bowl.

They did pass their re-inspection a few days later. It’s worth noting that many of the same/similar violations happen repeatedly.

Tobacco Violations – Selling Cigarettes to Minors

In our last update, we noted that “On December 1, 2014 an inspector representing the United States Food and Drug Administration observed either the owner or an employee sell cigarettes to a minor at the Eagle Creek Marathon. You can view the warning letter that was issued here: (Source)”

Since that time, the FDA sought a civil money penalty against the Eagle Creek Marathon due to 3 violations within 24 months. You can view the legal document including details on the allegations: (Source)

According to the FDA Website, at least 2 of the violations involved a sale of tobacco products to a minor. There is not information available on the third violation yet.

The sale of tobacco products to minors is especially concerning because of the proximity of their proposed development to an elementary school.

Permit Violations

In the past year, the Eagle Creek Marathon has had multiple Department of Code Enforcement violations and stop work orders issued.

On June 1, 2016 they received the following violations:

“FOUND PROPERTY DID NOT MEET CONDITION OF VARIANCE, SPECIFICALLY LANDSCAPING PLAN, IS CONDUCTING OUTDOOR DISPLAY, STORAGE, AND OPERATION, AND HAD SEVERAL WINDOW SIGNS WITHOUT PERMITS. – BDR” (source)

On October 23-26, 2015 they received four violations and stop work orders for not having the proper permits for some construction they were doing.
