Today, the Indiana Court of Appeals issued their ruling and reversed Judge John Hanley’s decision to revoke the Improvement Location Permit. This ruling allows the developer to keep the permit and to proceed with the proposed development.

We are obviously disappointed by this ruling and are considering all of our options going forward including additional appeals. The surrounding community has overwhelmingly shown that there is no need or desire for the proposed gas station and convenience store. We will continue to oppose the development and not support even if it is ultimately successful.
