Next Hearing: December 8, 2015

12/8 Important Hearing Notice: 

We just received word that one of the 4 board members will not be able to make it to the hearing today. That means that there will only be 3 board members present- greatly increasing the probability of another indecisive vote. They are attempting to find an alternate, but that is probably unlikely at this point.

We are still planning to go to the hearing and are ready to present our case. However, if there are only 3 board members present, we are going to ask that it be continued until January. That said, there are no guarantee that the continuance will be granted and the case may still be heard.

Unfortunately, we don’t have much control over the circumstances but are attempting to keep you as informed as possible.

 

The next hearing will be on Tuesday, December 8, 2015 at 1pm.

The Metropolitan Board of Zoning Appeals Division II will hear two of our appeals:

  • Improvement Location Permit (2015-AP2-001)
  • Flood Permit (2015-AP2-002)

The board has the authority to revoke the issued permits and stop the proposed gas station. Here are the details on the hearing:

When: Tuesday, December 8, 2015 at 1:00pm.
What: Board of Zoning Appeals Division II
Where: Public Assembly Room, 2nd Floor of the City-County Building, 200 E. Washington St.
Parking: Here is a list of places to park around the City-County Building

Please come and show your support for the appeals! We realize it is during the day and many have to work, but if you have some flexibility in your schedule, please make every effort to attend. At the November hearing, those in opposition to the gas station had the opportunity to stand and be recognized.

We, the petitioners, are given 15 minutes to present our case. The remonstrators, the developer, is then given 15 minutes for their side followed by 5 minutes of rebuttal/closing statements for each side.

If the votes during the December 8 hearing are also indecisive, our appeals will be transferred to another division.

During the November 10th Hearing, the vote was 2-1 (in our favor). Three votes are needed for any action of the board to be official & only three board members were present. We hope there will be more board members present during the December 8th hearing.
